THE BATTLE OF THE CENTURYBy Barbara Davis, CHATP Co-Chair | April 9, 2011 The noisy, ugly demonstrations which occurred in State capitols across our country last month graphically illustrate the ‘Battle of the Twenty-First Century.’ This battle is not about mean governors and selfish tea party members versus teachers or firefighters or policemen, as portrayed by the media. It is really not even about collective bargaining or workers’ rights. Rather it is the life-and-death struggle between the hard-working, hard-pressed citizen-taxpayer pitted against powerful union bosses engaged in pay-to-play politics with liberal/progressive legislators. The ultimate agenda of such union bosses is the redistribution of wealth in America though continuing control of our government. Play-to-play is an insidious and cynical system of moneyed forces out-spending opponents in elections so they will receive favors and lucrative contracts from the elected officials. Those recipients then support the politicians in re-election and so on. With each cycle this partnership accumulates more power and more money (i.e., our money, in the form of higher taxes and other costs) and is therefore more and more difficult to defeat. Miraculously, in recent elections many of these high-spenders — governors as well as legislators-- were ousted by informed voters. Now, in places such as Madison, WI, Columbus, OH, and Trenton, NJ, voters are having to fight all over again, in a sense, the entrenched losers. With no consideration for nearly bankrupt state governments or financially strapped taxpayers, (which of course include both public and private sector union members), the power combo of union bosses and their politician buddies hurl vitriolic, and often false, rhetoric at the challengers. In New Jersey Governor Christie has brilliantly re-framed the whole public workers’ pension/benefits argument by pointing out that he is not targeting teachers or any public workers per se, but rather their union bosses, who have become rich and powerful on union dues. With pay-to-play union bosses are able to bargain across the table from the very politicians they put into office. No wonder collective bargaining — which is not intrinsically evil —has become an insupportable ‘right.’ Particularly in our state where binding arbitration generally ends in victory for labor, the taxpayer is effectively left out of the process altogether, and simply stuck with the bill. Now the unions/politicians have cleverly reframed the issue as an effort to remove public sector collective bargaining as a tool in labor disputes, and polls show that many members of the public may be buying that. First of all, I cannot find that ‘right’ anywhere in the Constitution or Bill of Rights, can you? Second, there has been no threat, either in Wisconsin or other states to strip workers of that privilege in salary negotiations, only in the budget-busting retirement and health benefits where public workers’ contributions are far less than those in the private sector. Taxpayers simply cannot support that inflated level of compensation any longer. Contrary to the unions’ claims that they are fighting to preserve the middle class, they are actually hastening its demise. CHATP URGES CAMDEN COUNTY RESIDENTS TO REMAIN VIGILANT REGARDING CONSOLIDATION OF POLICE AND FIRE FORCESBy CHATP Staff | March 23, 2011Cherry Hill, New Jersey (March 23, 2011) -- The Cherry Hill Area Tea party (CHATP) urges Camden County residents to remain vigilant regarding possible consolidation of the Countys municipal police and fire forces. CHATPs call comes ahead of a meeting scheduled for Wednesday, March 23, at Camden County College in Blackwood, New Jersey. The meeting between New Jersey Governor Chris Christie and State Senate President Stephen M. Sweeney, together with other state, county, and local leaders, is expected to examine potential approaches to consolidation of municipal police and fire service into a Camden County-wide system. If consolidation is not structured equitably, or if it is not contingent upon a vote of affected residents, it poses real risks for taxpayers, said CHATP Co-Chairwoman Barb Davis. Middle class taxpayers face the prospect of having to fund a disproportionate share of the costs of consolidation, while at the same time receiving a disproportionate share of the benefits. Underlying CHATPs concern is the current environment in which many taxpayers in Camden County receive relatively little for their contributions to State and County government. For example, middle class communities such as Cherry Hill currently receive back from Trenton only eight cents of every dollar their residents pay in state income tax, or a return of -92%. By contrast, the City of Camden receives back from Trenton $48.33 of every dollar its residents pay in state income tax, or a return of 4833%. As a result of perennially poor leadership and a lack of fiscal accountability in cities such as Camden, those cities have been unable to fund their public safety operations fully and have been forced to trim those operations, said Angela Pizzo, CHATPs Co-Chairwoman. We are concerned that the Camden County Board of Chosen Freeholders, rather than addressing this leadership gap, proposes instead to have middle class taxpayers bail out those cities by redistributing their police and fire services to a common pool. CHATP also calls upon Governor Christie, Senate President Sweeney, and county and local leaders to pledge that any consolidation plan will be put to the vote of affected residents, for example through a ballot measure. According to Barbara Davis: We will of course withhold final judgment on any consolidation plan pending its release in draft form. That being said, our members recently attended a meeting of the Camden County Board of Chosen Freeholders in Cherry Hill in which it was suggested that County and local leaders could consolidate without putting the matter to a vote of affected residents. Police and fire services are too critical to the public safety and finances of our towns to deny local residents the opportunity to vote on any plan. Furthermore, CHATP is concerned that police and fire consolidation could be pushed through without adequate consideration of its complexities. As everyone knows, the devil is in the details, said Barbara Davis. An issue often overlooked or downplayed in consolidation efforts is how the combined system will deal with preexisting contractual obligations and debt of each merging force. For example, when the Township of Cherry Hill consolidated its fire operations in the early 1990s, it failed to consider fully the preexisting lease obligations and debt of the fire companies it acquired, and it subsequently lost a court case in which it tried to wash its hands of some of those obligations. At this point we have no concept of the size and scope of the preexisting, liabilities, debt, and lawsuits carried by some of the municipalities that would be consolidated, raising the real specter that middle class taxpayers could be called upon to shoulder both substantial preexisting costs as well as future costs. Despite the challenges, CHATPs Angela Pizzo notes that the current examination of consolidation has the potential to be positive and that Governor Christie and others should be commended for at least weighing the options. Tea parties are not opposed to police and fire consolidation in all shapes and forms, especially if the consolidation plan includes specific, demonstrable, and long-term tax cuts, she said. In fact, certain aspects of our police and fire, such as Camden Countys county-wide dispatch system, are already consolidated today. That being said, consolidation must not be undertaken lightly, must be subject to the consent and the vote of residents, and must be structured in a way that mitigates the potential for political and financial abuses.CHATP and Other Local Tea Parties Call On New Jersey Residents to Reject Outside Union Interference In State AffairsBy CHATP Staff | February 24, 2011 Cherry Hill, New Jersey (February 24, 2011) -- Local tea parties today called on New Jersey residents to reject attempts by the Washington, D.C.-based AFL-CIO to perpetuate an unsustainable public sector benefits and and pension system in their state. The Cherry Hill Area Tea Party, along with the Greenwich Tea Party Patriots of South Jersey, Independence Hall Tea Party Association, Tea Party Patriots of Southern New Jersey, and West Jersey Tea Party, put out the call in response to a rally planned by the AFL-CIO and other unions on Friday, February 25th, in Trenton. The AFL-CIO is busing into New Jersey its national leadership, including AFL-CIO national president Richard L. Trumka, as well as members from Wisconsin and other states, in an effort to dictate to those of us who live and pay taxes in New Jersey how our state should spend its revenue, said Barbara Davis, co-chair of the Cherry Hill Area Tea Party. Clearly this smacks of outside interference in New Jersey affairs from a union more interested in dues than the financial survival of our state. The public employee pension system in New Jersey is currently underfunded by more than $53 billion, with that number expected to grow to more than $180 billion over the next three decades if no immediate action is taken, said Teri Adams, president of the Independence Hall Tea Party Association. Additionally, the healthcare benefits system covering public employees is underfunded by more than $67 billion. Yet union bosses out of Washington want New Jersey taxpayers to continue to suck it up as they drive our state into bankruptcy, she added. According to Susan Lord, founder and president of Tea Party Patriots of Southern New Jersey: New Jersey tea parties respect the contributions of our public sector employees to the health and welfare of our state, including the contributions of our police, fire, teachers, and other public workers. However state residents believe strongly in a meaningful balance between public sector benefits and fiscal responsibility, particularly at a time when New Jersey continues to suffer the effects of a deep recession, one of the highest tax burdens in the U.S, and an underemployment rate exceeding 15% . A keynote speaker at this coming Fridays AFL-CIO event will be national AFL-CIO president Richard L. Trumka, who also serves on the board of directors of the Economic Policy Institute an organization managed by members of the Democratic Socialists of America and others. The National Right to Work Legal Defense Foundation has cited Mr. Trumka for past union-related activities that allegedly included militancy, disregard for the rule of law, and condoning of violence by union operatives. New Jersey tea party members are sick and tired of out-of-state government and union bureaucrats telling us how to run our state," said Barbara Davis. "We saw the same strong-arm tactics used recently in Wisconsin, where the White House and unions from outside Wisconsin bused their supporters to the state capitol at Madison in an effort to attempt to overcome overwhelming support for Governor Scott Walkers overhaul of the Wisconsin public workers' pension and healthcare benefit system. VERSION 1.1 (EFFECTIVE: January 14, 2011)In consideration of being given the opportunity to participate in meetings, excursions, protests, rallies, petitions, polling, and other activities, whether in person, online, or otherwise (the “"Activities"”), organized, sponsored, promoted, and/or otherwise facilitated by the Cherry Hill Area Tea Party (“"CHATP"” or "“the CHATP"”), you agree, for yourself, your personal representatives, heirs, assigns, and next of kin, to the terms and conditions of this document (the “"Agreement"”), irrespective of whether you have signed this Agreement or not.YOU UNDERSTAND THAT THIS AGREEMENT, INCLUDING, BUT NOT LIMITED TO, ARTICLE I, SECTIONS 1.1 AND 1.2 (ASSUMPTION OF RISK, RELEASE, AND HOLD HARMLESS), HAS IMPORTANT LEGAL CONSEQUENCES FOR YOU AND IS BINDING UPON YOU. IF YOU HAVE QUESTIONS ABOUT THE TERMS OF SERVICE OF ANY BUS COMPANY OR ANY OTHER SUPPLIERS OF SERVICES CONNECTED WITH THE ACTIVITIES, INCLUDING, WITHOUT LIMITATION, SUCH SUPPLIERS’ TERMS OF SERVICE OR LIMITATIONS OF LIABILITIES, YOU ACKNOWLEDGE THAT YOU ARE BEING ADVISED HEREBY TO DISCUSS YOUR QUESTIONS WITH SUCH PROVIDERS DIRECTLY.1.4 PARTICIPANTS UNDER AGE 18. IF YOU ARE ACCOMPANIED IN A PARTICULAR ACTIVITY BY ANYONE UNDER 18 YEARS OLD (EACH, A “MINOR”), OR OTHERWISE AUTHORIZE A MINOR TO PARTICIPATE IN AN ACTIVITY, YOU REPRESENT AND WARRANT THAT YOUR ARE THE PARENT/GUARDIAN OF SUCH MINOR AND HAVE THE AUTHORITY TO ENTER INTO THIS AGREEMENT ON BEHALF OF EACH SUCH MINOR, INCLUDING, WITHOUT LIMITATION, THE AUTHORITY, ON THE MINOR’S BEHALF, TO ASSUME ALL RISKS, RELEASE ALL CLAIMS, AND TO AGREE TO INDEMNIFY THE RELEASEES. YOU AGREE TO DEFEND, INDEMNIFY, AND HOLD HARMLESS THE RELEASEES AGAINST ANY CLAIMS RESULTING FROM THE FAILURE OF THE FOREGOING REPRESENTATION TO BE TRUE IN ANY RESPECT AND/OR THE FAILURE OF THIS AGREEMENT TO BE ENFORCEABLE WITH RESPECT TO ANY SUCH MINOR. 1.5 ADDITIONAL TERMS. YOU UNDERSTAND AND AGREE THE CHATP AND/OR ANY OF THE OTHER RELESSEES, AS A CONDITION OF YOUR PARTICIPATION IN A PARTICULAR ACTIVITY OR ACTIVITIES, MAY REQUIRE YOU TO EXECUTE A SEPARATE, ADDITIONAL RELEASE AND HOLD HARMLESS AGREEMENT(S) OR TO AGREE TO ADDITIONAL TERMS AND CONDITIONS GOVERNING YOUR PARTICIPATION. SUCH SEPARATE AGREEMENT(S) AND SEPARATE TERMS AND CONDITIONS SHALL SUPPLEMENT, AND SHALL NOT REPLACE, THE PROVISIONS OF THIS AGREEMENT. IF YOU HAVE ANY MINORS ACCOMPANYING YOU ON SUCH ACTIVITY OR ACTIVITIES, YOU MAY ALSO BE REQUIRED TO EXECUTE A SEPARATE AGREEMENT(S) FOR EACH MINOR, AS A CONDITION OF THE MINOR'’S PARTICIPATION IN THE ACTIVITY OR ACTIVITIES. YOU UNDERSTAND AND AGREE THAT ANY FAILURE OF THE PROTECTED PARTIES TO REQUIRE A SEPARATE RELEASE FROM YOU FOR A PARTICULAR ACTIVITY OR ACTIVITIES SHALL NOT AFFECT THE SCOPE OR ENFORCEABILITY OF THIS AGREEMENT. ARTICLE II. CODE OF CONDUCT2.1 Code of Conduct. The code of conduct below (the "“Code”") must be followed at all times with respect to your participation in CHATP. Notwithstanding anything to the contrary in this Agreement, CHATP reserves the right to revise the Code, with or without prior notice, and to post the revised Code to www.chatp.org (or any other applicable hyperlinked or successor website). Accordingly, and you are hereby advised to consult the aforementioned website regularly in order to ascertain whether any changes have been made to the Code.“"Spirited debate is a core and essential element of our political system. At the same time, each participant in CHATP understands and agrees that he/she is personally responsible for ensuring that his/her conduct, as well as the conduct of any Minors, preserves CHATP’s positive image and complies with applicable law.CHATP is also keenly aware of the aim of a narrow group of individuals and organizations who oppose our principles to disrupt the activities of Tea Parties and to portray such organizations in a bad light by acting in an offensive or illegal manner during the public activities of Tea Parties.You agree that, under no circumstances, will it be acceptable for you to disrupt any Activity of CHATP or another Tea Party, to attempt to subject CHATP or another Tea Party to ridicule or scorn, to subject others to slurs or insults based on race, creed, religion, etc., or to subject others to harassment or abuse, or to engage in unlawful or violent behavior in connection with any Activity.”"2.2 Additional Requirements. Please be aware that the Code above does not cover each and every issue that may arise. All participants in CHATP must, in a more general sense, avoid improper behavior in connection with CHATP.2.3 Violations of Code. If you violate the Code, the Chair of CHATP or his/her designee may, in their sole discretion, remove you from an Activity and/or suspend or exclude you permanently from participation in CHATP. If you are removed during an Activity which uses the transportation of one of CHATP’s suppliers, the Chair or his/her designee, at their option, may require that you locate an alternate means of transportation back to the point of departure, at your sole cost and expense. The Chair of CHATP or his/her designee reserves the right to decline to accept any person as a participant in CHATP and/or in a given Activity when such action is determined by the Chair(s) or such designee to be in the best interests of the health, safety, or general welfare of CHATP, the other participants in the Activity, or you. 2.4 Indemnification. You, your successors, heirs, and assigns shall indemnify, defend (with counsel acceptable to the Chair of CHATP), and hold harmless the Releasees from and against any and all demands, claims, suits, cause or causes of action, whether at law or in equity, costs, expenses, and reasonable attorneys’ fees caused by, growing out of, or happening in connection with, your and, to the extent you are facilitating the participation of any minor in the Activities, such minor’s, violations of the Code. Furthermore, you acknowledge and understand that should your conduct violate applicable law, you may be subject to sanction by the applicable law enforcement authorities, with respect to which you shall bear sole responsibility and liability. ARTICLE III. RIGHTS OF PUBLICITY AND PRIVACYYou understand and agree to grant irrevocably to CHATP its successors, and assigns the worldwide, royalty-free right, license, and authority to copyright, use, and publish your voice, picture, name and likeness for advertising, publicity, promotional and other purposes in connection with the Activities in any form, including and without limitation, newspapers, magazines, videos, audio tapes, video tapes, television and radio broadcasts, web streams and web pages. The right, license, and authority shall belong to CHATP, its successors, and assigns at all times and shall survive the termination of this Agreement. No compensation shall be paid or payable to you for any right or use granted to CHATP, its successors, and assigns by you. Although CHATP, its successors, and assigns, at your request, may use commercially reasonable efforts, at their sole option and discretion, to remove your voice, picture, name and likeness from any such materials, you expressly acknowledge and agree that they shall have no obligation to do so.ARTICLE IV. WEB, ELECTRONIC, AND PRIVACY POLICIESYour receipt of, transmission to, use of, or other interaction with, any website, webpage, email, text message, or other digital or electronic communications or platform, made by or on behalf of CHATP” (collectively, the "Platforms"), as well as all content, services and products available through any of the foregoing Platforms, including, but not limited to, CHATP’'s presence on www.chatp.org and www.facebook.com, is subject to the "Web, Electronic & Privacy Policy," available here.ARTICLE V. MISCELLANEOUS5.1 Except as otherwise provided in Section 1.5 and in Article IV, this Agreement constitutes the entire agreement between CHATP and you concerning the subject matter hereof, and may only be modified in writing by the Chair of CHATP and/or his/her designee, or by the posting by CHATP of a revised version. Except to the extent otherwise required by applicable law, this Agreement will be governed by the laws of the State of New Jersey, United Staes of America, excluding its conflict of law provisions, and the proper venue for any disputes arising out of or relating to any of the same will be the state and federal courts located in Camden County, New Jersey. Except for claims for injunctive or equitable relief or claims regarding intellectual property rights (which may be brought in any competent court without the posting of a bond), any dispute arising under this Agreement shall be finally settled in accordance with the Comprehensive Arbitration Rules of the Judicial Arbitration and Mediation Service, Inc. (“JAMS”) by an arbitrator appointed in accordance with such Rules. The arbitration shall take place in Cherry Hill, New Jersey, in the English language, and the arbitral decision may be enforced in any court. The prevailing party in any action or proceeding to enforce this Agreement shall be entitled to costs and attorneys’ fees. If any part of this Agreement is held invalid or unenforceable, that part will be construed to reflect the parties’ original intent, and the remaining portions will remain in full force and effect. A waiver by either party of any term or condition of this Agreement or any breach thereof, in any one instance, will not waive such term or condition or any subsequent breach thereof. This Agreement will be binding upon and will inure to the benefit of the parties, their successors, heirs and assigns.5.2 CHATP'’s delay or failure to exercise any of its rights under this Agreement does not prevent it from exercising such rights at a later date. If any provision of this Agreement is deemed to be illegal or invalid, it shall not invalidate the remaining provisions of this Agreement. Obligations of the parties set forth in this Agreement arising out of events occurring during the life of this Agreement will survive termination of this Agreement.
